These Terms of Service (“Terms”) constitute a legally binding agreement between you and Core Confidence Coaching Pty Ltd (ABN to be displayed on invoice) trading as Core Confidence (“we”, “us”, “our”). By accessing our website at coreconfidence.coach or engaging our coaching services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Acceptance of Terms
By accessing our website, completing a booking, making a payment, or participating in any of our coaching programs, you confirm that you have read, understood, and agree to these Terms, together with our Privacy Policy, which is incorporated into these Terms by reference.
These Terms apply to all visitors, clients, and users of our website and services. If you are accessing or using our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
We reserve the right to update these Terms at any time. Continued use of our website or services after any update constitutes acceptance of the revised Terms.
Our Services
Core Confidence Coaching Pty Ltdprovides men's dating and confidence coaching services, including but not limited to:
- The Immersive Experience - in-person dating and social coaching programs delivered in Melbourne, Sydney, Perth, Brisbane, and Adelaide, conducted over multiple weeks with live field sessions, 1-on-1 coaching, and group workshops;
- Online Dating Coach - a comprehensive online dating profile overhaul and coaching service, including photography coordination, profile writing, texting strategy, and results guarantees as specified at time of purchase;
- Online Foundations - a self-paced online video course covering foundational skills in confidence, social dynamics, and attraction; and
- Ancillary services - such as 1-on-1 consultation calls, podcast content, community access (Discord), and any other programs or products we may offer from time to time.
We reserve the right to modify, suspend, or discontinue any service offering at any time with reasonable notice. Descriptions and inclusions for each program are as specified on our website or in your enrolment agreement at the time of purchase.
Eligibility
Our services are intended for adult males aged 18 years or older. By engaging our services, you confirm that you are at least 18 years of age.
We reserve the right, in our sole discretion, to decline to provide services to any person. We may decline an enrolment or terminate an engagement if, in our assessment, our services are not appropriate for a prospective client's circumstances, or if a client's behaviour is inconsistent with the obligations set out in Section 6.
Our coaching programs are not a substitute for professional psychological, psychiatric, or medical treatment. If you are experiencing a mental health condition, we encourage you to seek support from a qualified health professional.
Booking & Payment
Booking
A booking or enrolment is confirmed upon receipt of the required deposit or full payment, and our written confirmation to you. All bookings are subject to coach and program availability.
Pricing
All prices are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Prices are subject to change without notice prior to a confirmed booking.
Payment
We accept payment via the methods specified on our website or in your enrolment agreement. Where payment plans are offered, you agree to make each instalment by the due date specified. We reserve the right to suspend access to services in the event of a missed payment.
GST
Core Confidence Coaching Pty Ltd is registered for Goods and Services Tax (GST) in Australia. GST (currently 10%) is included in all prices unless clearly stated otherwise. A tax invoice will be issued upon request.
Cancellations & Refunds
We want every client to feel confident in their investment. The following cancellation and refund terms apply, subject to your rights under the Australian Consumer Law (ACL) as set out in Section 11.
Client-Initiated Cancellations
- More than 14 days before program commencement: A full refund of any amounts paid, less any non-refundable deposit specified in your enrolment agreement.
- 7–14 days before program commencement: A 50% refund of the total program fee paid, less any non-refundable deposit.
- Less than 7 days before program commencement, or after commencement: No refund is available, except where required by the ACL.
Rescheduling
We understand circumstances change. Rescheduling requests made more than 7 days before commencement will be accommodated where possible, subject to availability, at no additional cost. Requests made less than 7 days before commencement may incur a rescheduling fee as notified to you at the time.
Results Guarantees
Certain programs (e.g. the Online Dating Coach) include a specific results guarantee as detailed in the program description at the time of purchase. Where such a guarantee applies, the specific terms of that guarantee will be provided to you in writing at enrolment. Guarantees are subject to you fulfilling all client obligations (see Section 6) and are not available if you have materially misrepresented your circumstances.
Our-Initiated Cancellations
If we cancel a program for reasons not attributable to you (e.g. coach unavailability or force majeure), we will provide a full refund or an alternative date, at your election.
Client Obligations
To get the most from our programs and to maintain a productive coaching relationship, you agree to:
- Engage honestly and openly with your coach and provide accurate information about your circumstances, goals, and history;
- Actively participate in all sessions, exercises, and activities as directed;
- Treat all Core Confidence coaches, staff, and other clients with respect: discrimination, harassment, bullying, or threatening behaviour will result in immediate termination of your engagement without refund;
- Not record, share, or publish any session content, coaching materials, or proprietary methodologies without our prior written consent;
- Comply with all applicable laws during the course of any in-person field coaching activities, you are solely responsible for your own conduct when interacting with members of the public;
- Understand that outcomes are dependent on your effort, circumstances, and individual application; we cannot guarantee specific results unless explicitly stated in our official “Our Guarantee” or a written guarantee at the time of enrolment; and
- Notify us as soon as possible if you are unable to attend a scheduled session.
Intellectual Property
All content on our website and within our programs, including but not limited to course videos, written materials, frameworks, methodologies, graphics, logos, and brand assets, is the intellectual property of Core Confidence Coaching Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use our materials solely for your personal use in connection with the services you have purchased. You may not:
- reproduce, distribute, sell, sublicence, or create derivative works from any of our content;
- share login credentials or provide access to our online programs to any third party; or
- use our brand name, logo, or trademarks without prior written consent.
Any feedback, testimonials, or content you provide to us may be used by us for marketing, quality improvement, and promotional purposes, subject to our Privacy Policy.
Confidentiality
We understand that coaching involves sharing personal and sometimes sensitive information. We treat all information you share with us as confidential and will not disclose it to third parties except as set out in our Privacy Policy or as required by law.
Similarly, you agree to keep confidential any proprietary information, methodologies, or frameworks shared with you as part of our programs, and not to disclose these to third parties or use them for any purpose other than your personal development.
Coaches may share anonymised, de-identified client stories or experiences in training, marketing, or educational contexts, but will never disclose your identity or identifying details without your explicit consent.
Disclaimers
Our coaching services are educational and developmental in nature. While our coaches have extensive experience and a strong track record, nothing on our website, in our marketing materials, or in our communications constitutes a guarantee, promise, or absolute representation of how we work, operate, or the results you will achieve. We make no guarantee of specific results unless explicitly provided in our official “Our Guarantee” or a specific written guarantee provided to you at the time of enrolment.
Our services are not a substitute for professional psychological, psychiatric, relationship counselling, or medical advice. If you are experiencing serious mental health challenges, please seek support from a qualified health professional.
Our website and materials are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties (express or implied) in relation to our website, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot be excluded under the ACL.
We do not warrant that our website will be uninterrupted, error-free, or free from viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, and subject to Section 11 (Australian Consumer Law), our total liability to you for any loss or damage arising out of or in connection with these Terms or our services (whether in contract, tort, statute, or otherwise) is limited to the total fees paid by you for the specific service giving rise to the claim in the 12 months preceding the event.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
In particular, we are not liable for:
- Your conduct or actions during any in-person coaching activity;
- The actions or omissions of third parties, including dating app platforms or individuals you meet in the course of applying coaching techniques;
- Any loss or damage arising from your failure to follow our guidance or fulfil your obligations under Section 6; or
- Interruptions to, or errors in, our website or online program access.
Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010(Cth)) (“ACL”) that cannot be excluded, restricted, or modified by agreement.
Under the ACL, our services come with consumer guarantees that cannot be excluded, including that they will be:
- provided with due care and skill;
- fit for the purpose we specified or you made known to us; and
- delivered within a reasonable time (where no time is agreed).
If we fail to meet a consumer guarantee under the ACL, you may be entitled to a remedy. For a major failure, you may be entitled to cancel your service contract and obtain a refund for the unused portion, or to receive compensation for the reduction in value. For a minor failure, we are entitled to remedy the failure within a reasonable time.
Nothing in these Terms is intended to limit or exclude any rights you have under the ACL that cannot be lawfully limited or excluded. Where our liability cannot be excluded, it is limited to the fullest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Core Confidence Coaching Pty Ltd, its directors, employees, coaches, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your breach of these Terms;
- your violation of any applicable law or regulation;
- your conduct during any coaching session or field activity; or
- any third-party claim arising from your actions or omissions in applying techniques learned through our programs.
Termination
We reserve the right to suspend or terminate your access to our services, without notice and without refund, if you:
- breach any provision of these Terms;
- engage in conduct that is harmful, threatening, harassing, discriminatory, or unlawful;
- fail to make a payment when due; or
- misrepresent your identity, eligibility, or circumstances to us.
You may terminate your engagement with us by providing written notice to us. Refunds upon termination are governed by Section 5 and applicable ACL rights.
Sections 7 (Intellectual Property), 8 (Confidentiality), 10 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) survive any termination or expiry of these Terms.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Victoria, Australia, and you irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and the Federal Court of Australia.
We encourage you to contact us in the first instance to resolve any dispute informally. If we are unable to resolve a dispute within 30 days of your written notice to us, either party may pursue their legal remedies.
Nothing in this clause prevents either party from seeking urgent injunctive or other interlocutory relief from a court of competent jurisdiction.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you via email or a prominent notice on our website.
Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We recommend you review these Terms periodically.
